FACILITY SURVEILLANCE ACKNOWLEDGEMENT
I acknowledge and understand that ACE ATHLETIC CENTRE operates a video surveillance system throughout certain areas of its facility for the purposes of safety, security, incident investigation, loss prevention, and the protection of participants, staff, volunteers, visitors, and property.
I understand that:
Video surveillance cameras may record my presence and activities, or those of my child, while on the premises.
Cameras are generally located in common areas of the facility, including entrances, exits, reception areas, hallways, courts, and other public or shared spaces. Cameras are not installed in private areas such as washrooms or change rooms.
Video recordings are the property of ACE ATHLETIC CENTRE and will be collected, stored, accessed, retained, and disclosed in accordance with applicable privacy laws and the Centre's policies.
Recorded footage may be reviewed by authorized personnel for safety, security, operational, insurance, legal, or investigative purposes and may be provided to law enforcement, insurers, legal representatives, or other authorized parties where required or permitted by law.
By entering and using the facility, I acknowledge that ACE ATHLETIC CENTRE may collect, use, retain, and disclose video recordings as described herein and in accordance with applicable privacy legislation.

LOST AND FOUND ACKNOWLEDGEMENT
I understand that I am solely responsible for my personal belongings while at ACE ATHLETIC CENTRE.
I understand that except where required by applicable law, ACE ATHLETIC CENTRE is not responsible for personal property that is lost, stolen, misplaced, or damaged while on its premises, including items left unattended in the facility, bathrooms, viewing areas, or parking areas.
I understand that any items found and turned in will be placed in the Lost and Found as a courtesy to participants. The Lost and Found is generally retained for a period of 7 days unless the items are perishable, unsafe or unsanitary. Unclaimed items remaining after this period may be donated, recycled, discarded, or otherwise disposed of in accordance with ACE ATHLETIC CENTRE’s Lost and Found procedure. Participants are encouraged to retrieve lost items as soon as possible.
I understand that while ACE ATHLETIC CENTRE will make reasonable efforts to safeguard and return lost property, it does not guarantee the security, condition, or return of any item held in the Lost and Found.
Notwithstanding any provision of this Acknowledgement, nothing herein is intended to limit, exclude, or modify any rights, obligations, duties, or liabilities that cannot lawfully be excluded or limited under applicable law, including, without limitation, the Occupiers' Liability Act (Alberta), the Personal Information Protection Act (Alberta).
By entering or using the facility, I acknowledge that I have read, understood, and agree to this Lost and Found Acknowledgement and accept responsibility for safeguarding my own personal property.
PARTICIPATION, ASSUMPTION OF RISK, RELEASE OF LIABILITY AND INDEMNITY WAIVER
I acknowledge that participation in activities at ACE ATHLETIC CENTRE involves inherent risks. These activities may include, but are not limited to, strength and conditioning, tryout sessions, birthday parties, tours, open gym sessions, camps, private lessons, competitions, special events, and the use of facility property, athletic equipment and other amenities.
I understand that participation in these activities involves risks that cannot be completely eliminated, including but not limited to:
Slips, trips, and falls;
Sprains, strains, fractures, dislocations, and other musculoskeletal injuries;
Head injuries, including concussion;
Exposure to communicable illnesses, including viral or bacterial infections;
Cuts, bruises, abrasions, and other minor injuries;
Serious injury, permanent disability, paralysis, or death;
Injuries arising from equipment failure or misuse;
Injuries caused by the actions or negligence of other participants, spectators, volunteers, or third parties; and
Other known and unforeseen risks associated with athletic activities and facility use.
I acknowledge that these risks may arise from my own actions, the actions of others, the condition of the premises, equipment, or facilities, or from risks that cannot reasonably be anticipated.
I, or the legal parent/guardian (if the participant is under 18), voluntarily choose to participate/ allow my child to participate, with full acknowledgement and appreciation of these risks.
I certify that I, or my child, am physically and medically able to participate in activities at ACE ATHLETIC CENTRE. I understand that it is my responsibility to consult a physician or other qualified healthcare professional if I have concerns regarding participation.
I agree to follow all facility rules, posted signage, safety instructions, and directions provided by coaches, instructors, staff, and volunteers. I understand that failure to follow safety instructions may increase the risk of injury and may result in removal from activities without refund.
In the event of an illness, injury, or medical emergency, I authorize ACE ATHLETIC CENTRE staff, employees, volunteers, or representatives to obtain emergency medical treatment that they reasonably believe to be necessary. I understand that ACE ATHLETIC CENTRE can not guarantee that an emergency contact or parent/legal guardian can be contacted in every given situation. I accept full responsibility for any medical, ambulance, hospital, or related expenses incurred.
To the fullest extent permitted by applicable law, I release, waive, discharge, and forever hold harmless ACE ATHLETIC CENTRE, its owners, directors, officers, employees, coaches, instructors, contractors, volunteers, agents, affiliates, and representatives from any claims, demands, actions, causes of action, damages, losses, liabilities, costs, or expenses arising out of or relating to any injury, illness, death, property damage, or other loss sustained while participating in activities or using the facilities of ACE ATHLETIC CENTRE, including those arising from negligence.
I agree to indemnify and hold harmless ACE ATHLETIC CENTRE, its owners, directors, officers, employees, coaches, instructors, contractors, volunteers, agents, affiliates, and representatives from any claims, liabilities, damages, costs, or legal expenses arising from my or my child's actions while participating in activities or using the facilities, except to the extent prohibited by law.
I understand that ACE ATHLETIC CENTRE reserves the right to suspend or terminate participation where a participant's conduct creates an unreasonable safety risk to themselves or others.
I understand that this waiver is intended to be interpreted broadly and to the fullest extent permitted under the laws of the Province of Alberta. If any provision of this waiver is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
In consideration of ACE ATHLETIC CENTRE providing me (the Participant) with the opportunity to participate in activities at ACE ATHLETIC CENTRE, use its equipment, or access its facilities (notwithstanding that any other fee has or will be charged), I hereby voluntarily execute this Liability Waiver in favour of ACE ATHLETIC CENTRE.
By signing below, I acknowledge that I am the participant named below or the legal parent/ legal guardian of the participant (if under 18). I confirm that I have had sufficient opportunity to read and understand:
this Facility Surveillance Acknowledgement and voluntarily acknowledge the use of video surveillance within ACE ATHLETIC CENTRE;
this Lost and Found Acknowledgement and accept responsibility for safeguarding my own personal property; and
this Participation, Assumption of Risk, Release of Liability, and Indemnity Waiver.
I acknowledge that I understand the contents and the legal effects of this document, including that I am giving up certain legal rights, including the right to bring legal proceedings or claims for damages arising from injury, property loss or damage, death (except where prohibited by applicable law) and voluntarily agree to be bound by its terms.
